Escrow Protection | Registered Freehold Ownership
Investor Protection in Dubai
1. Protection of Investor Funds in Off-Plan Properties
Off-plan property sales in Dubai operate within a regulated framework overseen by the Dubai Land Department (DLD) and the Real Estate Regulatory Agency (RERA).
A dedicated Real Estate Escrow Account is established for the development, and payments collected from off-plan purchasers are deposited into the project's escrow account.
The escrow account is administered through an approved bank or financial institution within Dubai's regulatory framework. Funds are released subject to the applicable project controls and construction progress.
Dubai's escrow legislation also provides for 5% of the total escrow account value to be retained after project completion, with release after the statutory retention period.
2. Legal Ownership for Foreign Investors
Foreign nationals may acquire Freehold property within designated areas of Dubai.
Freehold ownership is not limited to a fixed period of time, and the investor's property rights are formally registered through Dubai's official property registration system.
Accordingly, a foreign investor purchasing and registering a qualifying Freehold property acquires legally registered real estate ownership — not merely a temporary right to use the property.
